Terms of Service

Welcome to AccessLoad ("Service"), a distributed load testing platform operated by Ornate Software Solutions Pvt Ltd ("Company", "we", "us"). By creating an account or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Acceptable Use Policy

AccessLoad is a performance testing tool designed to help you test systems you own or have explicit written authorization to test. You agree to use the Service only for lawful purposes and in accordance with these Terms.

⚠️ Prohibited Activities

You agree that you will NOT use AccessLoad to:

Attack or degrade competitor systems: Using our platform to send load against websites, APIs, or infrastructure belonging to competitors or third parties with the intent to disrupt, slow down, or crash their services is strictly prohibited.
Conduct Denial of Service (DoS/DDoS) attacks: Any use of AccessLoad as a weapon to flood, overload, or render any system unavailable — whether directly or indirectly — is a criminal offense and will be reported to law enforcement.
Test systems without authorization: You must own the target system or possess explicit written permission from the system owner before running any load test. "I wanted to see how their site handles load" is NOT a valid justification.
Bypass rate limits or security controls: Using AccessLoad to probe, enumerate, or overwhelm authentication systems, firewalls, WAFs, or API gateways of third-party services.
Resell or redistribute the service: Offering AccessLoad's testing capabilities to third parties under your own brand without our written consent.
Generate abusive or illegal traffic: Including but not limited to spam, phishing, injection attacks, or scanning for vulnerabilities.

2. Authorization Requirement

Before running any load test, you represent and warrant that:

You are the owner of the target system, OR
You have obtained explicit written authorization from the system owner to perform load testing, OR
The target is a designated testing/staging environment specifically intended for such use.

We reserve the right to request proof of authorization at any time. Failure to provide proof may result in immediate account suspension.

3. Monitoring & Enforcement

We reserve the right to:

Monitor test targets to detect potentially abusive usage patterns.
Immediately suspend or terminate any account found violating these Terms without prior notice.
Report illegal activity to relevant law enforcement authorities, including sharing account information and test logs.
Block specific target domains or IPs if we receive abuse complaints from system owners.
Rate limit or throttle tests that appear to exceed authorized scope.

All load test metadata (target URLs, VU counts, durations, timestamps, and originating account) is logged for audit and compliance purposes.

4. Liability & Indemnification

You are solely responsible for any damage, disruption, or legal consequences resulting from tests you initiate through AccessLoad. By using the Service, you agree to:

Indemnify and hold harmless Ornate Software Solutions Pvt Ltd, its founders, employees, and partners from any claims, damages, losses, or legal fees arising from your use of the Service.
Accept full liability for any unauthorized testing conducted through your account, whether by you or anyone who gains access to your credentials.
Compensate affected parties for any provable damages caused by your misuse of the platform.

5. Account Security

You are responsible for maintaining the security of your account credentials. You agree to:

Use a strong, unique password for your AccessLoad account.
Not share your account credentials, API keys, or worker tokens with unauthorized individuals.
Notify us immediately at support@accesssure.in if you suspect unauthorized access to your account.

6. Service Plans & Payment

Free tier is subject to usage limits (200 VUs, 5-minute max duration, 7-day data retention).
Paid plans (Pro, Business) are billed monthly in Indian Rupees (INR) via Razorpay.
Cancellation takes effect at the end of the current billing cycle. No prorated refunds.
We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.
Accounts inactive for 90+ days on the Free tier may be automatically deleted.

7. Data & Privacy

Test results and scripts are stored according to your plan's retention policy (Free: 7 days, Pro: 30 days, Business: 90 days).
We do not sell your data to third parties.
Anonymized, aggregated performance data may be used to improve our AI analysis engine.
BYOC (Bring Your Own Cloud) workers process test data on your own infrastructure — we do not access or store data from BYOC workers beyond the metrics reported to our controller.

8. Service Availability

We strive for high availability but do not guarantee 100% uptime. The Service is provided "as is" without warranties of any kind. We are not liable for:

Temporary service interruptions for maintenance or upgrades.
Data loss due to infrastructure failures beyond our control.
Inaccurate test results caused by network conditions, target system behavior, or third-party dependencies.

9. Intellectual Property

AccessLoad, its UI, engine, AI analysis algorithms, and documentation are the intellectual property of Trayery. You may not reverse-engineer, decompile, or reproduce any part of the platform. Your test scripts and results remain your property.

10. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may delete your account at any time by contacting support@accesssure.in. Upon termination:

All test data, scripts, and results will be permanently deleted within 30 days.
Any outstanding payment obligations remain in effect.
Sections on Liability, Indemnification, and Intellectual Property survive termination.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

12. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email to registered users. Continued use of the Service after changes constitutes acceptance of the updated Terms.
